The first pub landlord in England to be prosecuted for ignoring the smoking ban is set to appear in court for the second time in a month.
Hamish Howitt, owner of the Happy Scots Bar and Delboys Sports Bar, Rigby Road, Blackpool, was fined a total of £2,515 last Monday for allowing smoking in his bars.
But just two days later enforcement officers from the council visited the bars, and smoking was again being allowed.
Mr Howitt will appear in front of Blackpool Magistrates again on Wednesday November 21.
