Smoking ban rebel defiant

A landlord who is defying the smoking ban is on the brink of prosecution and customers who continue to light up at his pub could shortly be issued with on-the-spot fines.

Hamish Howitt, of the Happy Scots Bar, Rigby Road, claims he will not pay any fines issued against him and is prepared to challenge the ban in court.

He has been openly defying the ban since its inception on Sunday and council officials have confirmed the pub is the only one in the borough that is flouting the new legislation.

Tim Coglan, head of quality standards at Blackpool Council said officers visited premises last weekend with the Happy Scots the only one to be issued with a warning.

He added: "Anyone found smoking on the premises is likely to be issued with a fixed penaly notice of £50. We are approaching smoke-free enforcement in a non-confrontational way, but if attempts to encourage compliance do not succeed it could result in prosecution and a possible loss of licence for offenders."

However Mr Howitt, says he is quite is quite happy to get locked up by defying the ban.

He said: "I suppose they are going to come after me but I believe I'm just standing up for what is right.

"I won't be stopping my customers smoking. I will go to jail if I have to, and I will go gladly."

l To mark the start of the ban, Houndshill Shopping Centre organised a No Smoking Awareness Day. Look-alikes from TV show Absolutely Fabulous characters Patsy and Edina handed out information to shoppers on how to give up smoking.

I am all for this. Well done Mr Howitt, although unless all of us who wish to oppose the ban take a stand no one will take any notice what so ever...but this country has gone to the dogs.

Statistics show that this is affecting mainly old people and the poor.
7 billion pounds is made by the government each year from us smokers....apparantl

As it is I have been drinking indoors since last sunday. My local pubs are half empty.
I have been in pubs in Scotland and Ireland since the ban started and would say it is a total disaster.We need a national pro smokers march on London.If I was a bit younger I would love to organise it.

Whats is this ban for, it is social engineering by the government and stops social interaction by a large proportion of the population, it is not about a health risk to non-smokers as there is no significant risk from second hand smoke to anyone, it is another lie which this Government has created, there is no epidemiological study which shows second hand smoke to have a relative risk factor over 3 (over 3 is significant) even the ones that have been fixed by ASH and Cancer research, combined these studies show a RR of well below 2.
The SCOTH committee created by government who say second hand smoke is harmful, are not speaking the truth, second hand smoke may be insignificantly harmful but so is water,coffee,most household products and cosmetics, also look at the other interests that some members of SCOTH have, ASH and pharmacutical interests, this committee is a disgrace to everything Britain stands for. Even HSE say in HSE OC 255/15 they cannot produce evidence that second hand smoke is harmful.

I'm getting angrier and angrier with the state of this country... catering to the lowest common denominators and then allowing only the snot-nosed, closed-minded busy bodies a say in BLANKET LAWS THAT AFFECT US ALL!
I love that the government claims that 80% of the public support it... Do they? Who asked? When were we asked? I never saw a vote, a form, a petition.. anything! Am I not a member of the public? If indeed this 80% figure has any basis in fact, it likely only means that 80% of the 100% of usual neighbourhood watch snoops, Hiacinth Bouquet types and anti-tolerance brigade are in support of it. Because it certainly isn't 80% of the population. Why can't there by licence applications for smoking premises like there are for alcohol consumption? That way, licenses could be given based on how many smoking VS non-smoking pubs/clubs there are currently in the area. Why not give people a choice? Did the UK turn into Nazi Germany or America when I wasn't looking? My god people, (anti-smokers included), it's our RIGHTS that are at stake here, not whether we smoke or not. If laws like this are ever allowed to go through then worse will follow... That's how Hitler got in power in the first place.

For the record, when these surveys are taken they ask a representative selection of people. They pick a random sample of people. I'm sure if the results said 80% were against the ban then all the pro-smokers would be praising the surveys.

For the record I don't work for ASH but I certainly support their cause. I just hate smoking and I am not narrow-minded or stupid as you abusive petty smokers keep saying. There has been countless epidemilogical evidence to prove (in simple terms for you arrogant smokers) that passive smoking is linked to illness. This is coming from true experts at reputable organisations like the BMA and BHF. There are NO benefits of smoking, and most of all it tastes and smells disgusting. You must be low to sink to using insults and abuse towards someone who is just expressing an opinion, or is that too much for your narrow-mind.

dear sir
anyone over the age of 25 yrs in this country who smoke are government encouraged smokers. for past governments allowed adverts for tobacco to be glamorised which made smoking seem to be the 'in" thing to do.
millions tried it millions did not like it, millions did and became addicts to nicotine. these millions who did pay taxes on their addiction and still do, to the tune of 6.5 billion pounds per year collectively.
now this new law of no smoking in public places has come into force a law that i agree with up to a point. that point is we who smoke cannot enjoy our social life like we used to.
games at pubs & clubs darts pool snooker dominoes all these are difficult to enjoy, and also we who smoke no matter what age must go outside to smoke, never mind what the weather is like.
my wife and i are in our seventies, this law has made us house bound. for the club we used has two flights of stairs to the entertainment room and therefore makes it impossible for us to enjoy our club anymore.
and in my opinion the law is illegal for the government has not allowed or subsidised clubs or pubs to alter the premises to cater for smokers. nor have they halved the taxes on tobacco but they wrecked our social lives. even though they encouraged our addiction this law was not given much thought.
as for smoking causing cancer. cancer is a gene which is in every human being its when the gene decides to go its own way our trouble starts.
people died in this country of cancer before sir walter raleigh introduced tobacco, more toxins are in the air we breathe from cars lorries aeroplanes etc. which pump these toxins out 24 7
and also young ladies who smoke are in more danger now of having their drink drugged while outside having a cigarette. than ever before

Which ones are they then, name me one, even if you believe the SCOTH report (which I don't) that you are 26% more likely to get lung cancer as a non smoker living with a smoker its still a load of Bol*%cks an Independent commission on tobacco effects placed the incidence of lung cancer at 10 per 100,000 people years for a non smoker living with a non smoker so a 26% rise in risk (if you believe the number) would equate to 12.6 per 100,000 people years. Hardly the overwhelming evidence needed for a total ban.

CJ wake up and smell the coffee and curtail your arrogance that you know it all, you are being spoon fed crap and you are not sophisticated enough to realise it.

hamish is my closest mate and people need to understand that he is fighting for freedom . he like my self is a none smoker but come on when a guy has 2 bars where one is smoking and the other is smoke free all you none smokers are left with a choice. why not ban the sale of tobacco and have a smoke free cuntry!! why do the government still allow the sale of tobacco but make people stand like outcasts as one lsdy had to do outside the bar with her guide dog one day and ended up being knocked down while her lifeline and companion had his paw stood on whilst a group of people hurried passed ,why couldnt she sit in the comfort of a smoking only bar and enjoy her holliday? hamish puts people before himself and allways will even if it means going to prison and loosing everything.you people should check his uk. fags web site out and learn a bit about this amasing and kind man.this guy gives his money to people in need , including down and outs and sick children that need money for treatment of illneses that our great government just dont seam to want to help.he even flew a young child to america and payed for a lymo and team of doctors to pick the child up from home and take to the airport. how many people do you know that have done that ? infact have you ever heard of any man and wife ( jo ) ever doing such a kind thing ???? he didnt even know the child !!!!hamish dosent even like the smell of smoke but he fights for what he belives and im behind him 100%.

why dont understand that as long as tobacco is sold in this cuntry and people like hamish (who may i add doesnt even smoke)have 2bars that he owns and wants one smoke free and and smoking that there shoudnt be a problem because if YOU dont like smoke then dont go to the bar in the first place. is that piece of advice easy enough for you to understand ?? dont go there then you wont have to waist your time writing letters . its easy my friend : smoking bars and none smoking bars, lets keep everyone happy.

well done hamish! all us smokers are being treated as outcasts! i agree on smoking bans in restaurants and cafes but not our pubs its a liberty and how bad does it look when you drive around town and everyone is standing outside?

There are more people smoking in public places than before the ban. Old people were tucked away in their locals and clubs out of young peoples sight. Now people are walking along the streets with a fag in hand, standing outside clubs and pubs.
It's not a good example to be giving our children because they want to know why these old people are not dead due to smoking all their lives. Also many elderly people have stopped going out because of the ban and not all of them are smokers. If their smoking pals stay in they do as well. I'm not a pro-smoker, however, facilities should be made for these people to be able to have a cigarette with their pint.
As for ex-smokers they are like alcoholics, prohibition is the easy answer.
